Emails, letters, and messages on your phone...the copyright on them is VERY obscure sometimes. Law shit just gets funny like that. Even though they sent the information to you, apparently they may still have some claim to it. Most of the time probably not though.

Good video. I think the poor manner in which YT handles DMCA's has a chilling effect on some YT vloggers fully/creatively expressing themselves. This has to hurt the quality of the content on YT and ultimately hurt the profit of YT, in my opinion. I don't think YT gets this view, and only sees the immediate hassles of regulating behavior on the site and carefully dealing with DMCA's. I have heard a few good ideas about building accountability into the DMCA, but I don't think YT is interested.

Interesting video. FYI, though you say about 7 minutes into the video that I'm not a YouTube partner, I AM, in fact, a YouTube partner.
Also, DMCA notices and counternotices are filed under penalty of perjury so, theoretically, there should be consequences for false DMCAs. Some of the problems you talk about would be helped if people who knowingly file false DMCAs ( which does not include good faith mistakes) had to face come real consequences for the perjury.

The DMCA mechanism as it stands has serious deficiencies. If I want your DOCs, I just file a false DMCA and wait for the counter claim. You don't give them to me and I want you off YouTube, I do it three times.
Easy fix is, these DOCs never get emailed. Instead they come via registered letter at the claimants expense.

Not bad for having a serious case of jet lag. I think you gave some good information on contacting YT. You're dead on about 'getting emo' in dealing with staff. Some apparatchnick could care less about a users emotional trauma. That's just the way it is.

I think a lot of this could be fixed if youtube allowed us to create a empowered community. First, everything not needing privacy should be public (all comments (history), ratings, same ip accounts, etc)... then we should have a weighted voting system based on number of videos produced, and viewer / subscription popularity, and complaints of harassment, theft, or abusive conduct should be put to a community vote... something like that anyway.
